Terms & Conditions
These terms apply to custom cake orders from Pugs & Petals Cakes in Townsville. I’ve kept them in plain English. If anything is unclear, ask me before you pay a deposit.

1. Who we are
Pugs & Petals Cakes ([REGISTERED_BUSINESS_NAME], ABN [ABN]) makes custom cakes in Townsville, QLD. Contact: [EMAIL], [PHONE]. In these terms, “we”, “us” and “I” mean Pugs & Petals Cakes, and “you” means the person placing the order.
2. Quotes
Every quote is in writing and is valid for 7 days. Prices on the website and in the Cake Builder are starting prices only. Your date is held only once your deposit is paid.
3. Deposit
- Custom cakes: a 50% deposit.
- Orders under $150 are paid in full when you book.
Your deposit holds your date and covers design time and early supply costs. It is non-refundable except as set out below or as required by the Australian Consumer Law.
4. Balance and late bookings
The balance is due 7 days before your celebration. If you book inside 14 days of your celebration, the full amount is due when you book. Bookings inside 7 days are taken only if a slot is free and include a rush fee of 25% (minimum $40).
5. Cancellations and date changes
If you need to cancel, please tell me in writing as soon as you can.
- More than 4 weeks before your celebration: your deposit is refunded minus a $30 admin fee, or you can move it to a new date within 12 months.
- From 7 days to 4 weeks before your celebration: the deposit is kept, because it covers the held date, design time and early supplies. Anything you paid above the deposit is refunded.
- Less than 7 days before your celebration: up to the full price may be kept where ingredients and decorations have already been bought or made. I’ll explain what has been spent.
Date changes: you get one free date change if you ask at least 14 days before and the new date is free. Your deposit moves to the new date. Otherwise the change is treated as a cancellation.
6. If we cancel
If I have to cancel your order for any reason, you get a full refund, including your deposit.
7. Design approval and changes
We agree your design in writing. Changes close 7 days before your celebration. Changes after the design is approved may cost extra, and I’ll tell you the cost before making them.
8. Creative licence
Every cake is handmade. Inspiration photos are a guide: I match the style and colours but don’t copy another artist’s work exactly. Colours can look different on screens. If a decoration is unavailable, I may use one of equal value and will tell you.
9. Allergies
My kitchen handles wheat, milk, egg, soy, almond, hazelnut, peanut and sesame and other tree nuts. I can make cakes without some ingredients, but I cannot guarantee any cake is free from traces of allergens. You must tell me about every allergy or dietary need when you order. See the allergen information.
10. Non-edible items
Cakes may contain dowels, straws, wires, picks, toppers and fresh or silk flowers. Remove these before serving. Fresh flowers are decorative only.
11. Pick-up
Please check your cake when you pick it up. Once it leaves my hands, care and transport are your responsibility. Follow the care card: air-con on, box flat on the car floor, and never leave it in a parked car. See cake care.
12. Delivery
Someone aged 18 or over must be there to receive the cake. I need the venue details and a contact for the day at least 7 days before. Responsibility passes to you once the cake is delivered and, for tiered cakes, set up. Waiting time after 15 minutes is $50 an hour.
13. Heat, weather and venue
I can’t be responsible for damage caused by heat, humidity or direct sun after delivery. In Townsville, keep cakes in an air-conditioned space until serving.
Wet-season road closures: if a road closure stops a delivery, I’ll contact you to arrange an alternative, or a refund for the part of the order that couldn’t be delivered. [Wording for the lawyer to finalise]
14. Hire items
Cake stands and other hire items have a hire fee (from $25) and a refundable bond of $50–$100. The bond is returned within 3 business days of the item coming back clean and undamaged.
15. Photos
I may photograph your cake and share it. I never show faces or tag you without permission. Tell me if your cake is a surprise.
16. If something isn’t right
If something isn’t right, contact me within 24 hours with photos (and the uneaten cake if possible) so we can work out a fair fix together. This does not limit your legal rights.
17. Payments
Pay by PayID or bank transfer, or by card. No card surcharges.
18. Gift vouchers
If you buy a gift voucher, it is valid for at least 3 years from the date it is issued. The expiry date is shown on the voucher, and there are no fees.
19. Your rights under the Australian Consumer Law
Our goods and services come with guarantees that cannot be excluded under the Australian Consumer Law. Nothing in these terms limits your rights under the Australian Consumer Law.
